“ราชทัณฑ์” แจง “เสอ จื้อเจียง” ร้องถูกขังเดี่ยว ล่ามโซ่ ไม่ได้รับการรักษา ยันไม่เป็นความจริง

ตามที่ได้มีการเผยแพร่ข่าวกรณี นายแส หรือเสอ จิ้นเจียง หรือจื้อเจียง ผู้ต้องขังชาวจีนซึ่งถูกควบคุมตัวอยู่ที่เรือนจำไทยถูกขังเดี่ยว ถูกล่ามโซ่ ถูกปฏิเสธไม่ให้ได้รับการรักษาพยาบาล ถูกปฏิบัติแบบไร้มนุษยธรรมเป็นพิเศษ และตกเป็นเหยื่อของการละเมิดสิทธิมนุษยชน นั้น

กรมราชทัณฑ์ ขอเรียนว่า ได้รับรายงานจากเรือนจำกลางคลองเปรมว่า ได้รับย้าย นายแส หรือ เสอ จิ้นเจียง หรือ จื้อเจียง สัญชาติจีนและกัมพูชา ความผิดฐาน เปิดบ่อนคาสิโน อันเป็นความผิดตามประมวลกฎหมายอาญาแห่งสาธารณรัฐประชาชนจีน จากเรือนจำพิเศษกรุงเทพมหานคร เมื่อวันที่ 9 ตุลาคม 2567 เนื่องจากเป็นผู้ต้องขังที่มีพฤติกรรมและพฤติการณ์ไม่น่าไว้วางใจและมีอิทธิพลทางการเงินสูง ตลอดจนอยู่ในระหว่างรอส่งตัวผู้ร้ายข้ามแดน โดยตั้งแต่วันที่รับตัวเข้ามาควบคุม เรือนจำฯ ได้ถือปฏิบัติตามกฎหมาย ระเบียบข้อบังคับโดยเฉพาะการดำเนินงานภายใต้มาตรฐานการปฏิบัติงานด้านการควบคุมผู้ต้องขัง (SOPs) เพื่อให้สามารถควบคุมดูแลผู้ต้องขังชาวต่างชาติให้ดำเนินการได้อย่างมีประสิทธิภาพ เป็นไปตามหลักสิทธิมนุษยชนและข้อกำหนดของสหประขาชาติสำหรับปฏิบัติต่อผู้ต้องขัง (Standard Minimum Rules for the Treatment of Prisoners / SMR)

แต่เนื่องจาก นายแสฯ ได้มีพฤติการณ์กระทำผิดวินัยเรือนจำ จึงต้องมีมาตรการควบคุมที่เข้มงวดขึ้น เพื่อให้อยู่ในระเบียบวินัย ตลอดจนข้อบังคับต่าง ๆ ของเรือนจำ ปัจจุบันนายแสฯ ได้ดำเนินชีวิตอยู่ในเรือนจำเป็นปกติ เมื่อเจ็บป่วยได้รับการรักษาจากแพทย์ รวมทั้งได้เข้ารับโปรแกรมการฟื้นฟูสภาพร่างกายอย่างสม่ำเสมอ และ นายแสฯ ได้รับการติดต่อสื่อสารกับทนายความเป็นประจำ มีการรับ-ส่งจดหมายผ่านระบบออนไลน์ และสามารถเขียนจดหมายได้ตามสิทธิ การเผยแพร่ข่าวกรณีของนายแสฯ จึงไม่เป็นความจริง

กรมราชทัณฑ์ ได้ยึดหลักการควบคุมดูแลผู้ต้องขังทุกราย ภายใต้มาตรฐานการปฏิบัติงานด้านการควบคุมผู้ต้องขัง (SOPs) รวมถึงยึดถือปฏิบัติตามกฎหมาย ระเบียบข้อบังคับ การปฏิบัติต่อผู้ต้องขังให้สอดคล้องกับมาตรฐานงานราชทัณฑ์ระดับสากล และข้อกำหนดมาตรฐานขั้นต่ำสำหรับการปฏิบัติต่อผู้ต้องขังขององค์การสหประชาชาติ ให้เป็นไปตามหลักสิทธิมนุษยชนโดยเคร่งครัด จึงขอชี้แจงเพื่อทราบโดยทั่วกัน

Clarification on Allegations Regarding the Treatment of Mr. She Zhijiang in Custody

In response to recent reports alleging that Mr. She Zhijiang, also known as Xue Zhijiang, a Chinese national currently detained in a Thai correctional facility, has been subjected to solitary confinement, the use of restraints, denial of medical treatment, and other inhumane practices, the Department of Corrections wishes to provide the following information.

The Department of Corrections has received a report from Klong Prem Central Prison confirming that Mr. She Zhijiang, who holds both Chinese and Cambodian nationalities, was transferred from Bangkok Remand Prison on October 9, 2024. The transfer was conducted due to concerns regarding his significant financial influence, behavior deemed untrustworthy, and his status as an inmate pending extradition under the Extradition Act, B.E. 2551 (2008). His conviction pertains to operating an illegal casino, which is an offense under the Criminal Code of the People’s Republic of China.

Since his transfer, the Department has adhered strictly to all legal and regulatory frameworks, with operations conducted in accordance with Standard Operating Procedures (SOPs). These procedures are designed to ensure the effective management of foreign inmates while maintaining compliance with international human rights principles and the United Nations Standard Minimum Rules for the Treatment of Prisoners (SMR). Due to violations of prison discipline by Mr. She, stricter control measures were implemented to ensure adherence to facility regulations and maintain good order of the prison.

Mr. She is being accommodated under regular correctional facility conditions. He has access to medical care as required and receives regular physical therapy. Furthermore, Mr. She has maintained consistent communication with his legal representatives and has exercised his right to correspond via both online systems and written mail. Claims suggesting otherwise are therefore inaccurate and do not reflect the facts of his custody.

The Department of Corrections remains steadfast in its commitment to uphold international correctional standards and ensure that all operations are conducted in accordance with human rights principles and the United Nations Standard Minimum Rules for the Treatment of Prisoners (SMR).
